These Terms of Service govern your use of Zalat Pizza websites, mobile experiences, restaurant information, promotions, rewards references, ordering links, and other Zalat-controlled digital services. By using these services, you agree to these Terms. Additional terms from Thanx, payment processors, delivery providers, app stores, or other services may apply when you use their platforms.
1. Eligibility and Accounts
You must be legally capable of entering into these Terms. If you are under the age of majority, you may use the services only with permission from a parent or legal guardian. You are responsible for information submitted through your account and for maintaining the security of account credentials managed through Zalat or a service provider.
2. Ordering, Payment, Pickup, and Delivery
Menus, prices, availability, taxes, fees, delivery areas, estimated times, and restaurant hours may vary by location and may change. An order is not accepted until confirmed through the applicable ordering service. Payment processing, delivery, refunds, credits, cancellations, and chargebacks may also be governed by the ordering, payment, or delivery provider’s terms and the policy shown during checkout.
Zalat links to Thanx-operated ordering and rewards services. Those services remain subject to the applicable Thanx platform terms; these Zalat Terms do not replace them.
3. Rewards, Offers, and Promotions
Rewards, promotional codes, discounts, free items, and limited-time offers are subject to the conditions displayed with the offer, including dates, participating locations, eligible items, redemption limits, and availability. Offers have no cash value unless required by law, may not be combined unless stated, and may be corrected or withdrawn in response to error, fraud, abuse, or legal requirements. Material offer restrictions will be presented with the offer rather than only in these Terms.
4. SMS and Electronic Communications
Marketing text messages require separate consent and are governed by the SMS Terms of Service. Marketing consent is not required to make a purchase. Transactional communications relating to an order or account are separate from recurring marketing messages.
5. Acceptable Use
You may not:
- Use the services unlawfully, fraudulently, or to harm another person.
- Interfere with security, access controls, networks, forms, or normal operation.
- Use automated means to scrape, overload, copy, or manipulate the services without written permission.
- Impersonate another person or submit false, misleading, infringing, or malicious content.
- Abuse promotions, rewards, refunds, customer support, or restaurant operations.
6. Intellectual Property and Feedback
Zalat names, logos, designs, menus, photographs, text, software, and other content are owned by or licensed to Zalat and protected by applicable law. These Terms grant only a limited, revocable, non-transferable right to use the services for personal, lawful purposes. If you voluntarily provide ideas or feedback, Zalat may use them without restriction or compensation, subject to applicable privacy law.
7. Third-Party Services and Links
Links to ordering, rewards, maps, delivery, payment, app-store, employment, gift-card, and social services are provided for convenience. Zalat does not control every third-party service, and use of those services is subject to their own availability, privacy notices, and terms. A link does not make Zalat responsible for a third party’s independent conduct.
8. Disclaimers
To the extent permitted by law, the digital services are provided “as is” and “as available.” Zalat does not guarantee uninterrupted access, error-free content, or that estimated availability, delivery times, restaurant hours, pricing, or nutrition information will always be current. Nothing in these Terms limits warranties or rights that cannot lawfully be excluded.
9. Limitation of Liability
To the extent permitted by law, Zalat and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the digital services. Any limitation applies only to the extent enforceable and does not waive rights or remedies that applicable consumer law does not permit Zalat to waive.
10. Suspension and Termination
Zalat may restrict or end access to digital services when reasonably necessary to address fraud, abuse, security, legal requirements, or violations of these Terms. Provisions that by their nature should survive termination will continue to apply.
11. Changes
We may update these Terms prospectively. The current version and effective date will appear here. Material changes will receive additional notice when required. Continued use after an effective update constitutes acceptance only to the extent permitted by law.
12. Governing Law and Venue
These Terms are governed by Texas law, without regard to conflict-of-law principles, and courts located in Dallas County, Texas, subject to nonwaivable consumer protections and jurisdictional rights. These Terms do not include an arbitration agreement or class-action waiver.
